The form of presentation of a trademark in the market is crucial so it can distinguish itself from the others before the consumer and, subsequently, the National Institute of Industrial Property – INPI grants its registration. In this case, a trademark can be protected as follows:

  • Nominative: comprised of words or set of words, letters, digit, spelled in any current alphabet.
  • Mixed: comprised of a nominative and figurative element simultaneously, or a nominative element whose form of presentation is significantly different from the usual writing.
  • Figurative: exclusively presented by drawing, image, badge or any kind of graphic sign without any nominative element.
  • Three-Dimensional: consists of the plastic form (format or physical configuration) of a product or package, whose form has a distinctive character in itself and is unrelated to any technical effect.

Protection will be ensured to the trademark in all such forms of presentation, and any change or alteration to its characteristic elements, as specified in the Certificate of Registration, will not be protected by the Industrial Property Law, Article 143, item II, of the Property Law.

 CLASSIFYING THE TRADEMARK

The trademarks are protected as per the classes in which they are filed, and third parties may not apply for signs that imitate or reproduce a trademark or a trademark application that has been previously filed for identical products or services. Therefore, the holder of a trademark application must indicate which products or services their trademark intends to protect, thus defining a relation of identity and origin between the trademark and a product or service.

Hence, the National Institute of Industrial Property – INPI provides a list of 45 previously defined classes describing several types of products and services and what belongs to each class.

 

WHAT IS REQUIRED?

Your trademark may be registered, as per the activity of product or service developed. If the expression is available, the registration application may be filed.
